Animals are generally not allowed to be housed on the Pelican Cove Condominium Association (PCCA) property under the PCCA Declaration Use Restrictions. An exception to this rule is extended to disabled residents and their disabled guests who require an assistance animal in accordance with the Fair Housing Act (FHA) as provide for in the PCCA Assistance Animal Policy 2019-3. The restriction will be waived by the Board of Directors on a case-by-case basis.
The Federal Fair Housing Act (“Housing Laws”) requires housing owners and managers to provide reasonable accommodations for residents who have disabilities that require an Emotional Support (ESA) or Service animal (collectively referred to herein as “Assistance Animal”). The Housing Laws define a person with a disability as “a person who has a physical or mental impairment that substantially limits one or more major life activity, a person who is regarded as having such an impairment, or a person with a record of such an impairment.”
As part of the disabled resident’s or guest’s waiver request, the resident and/or guest must agree in writing to the following Assistance Animals Rules. Violation of these rules may result in revocation of the waiver by the Board of Directors.
The disabled resident or guest must complete the following application and attach a completed Veterinary Health Certificate that you can download here. The Board of Directors will respond to your request within ten (10) business days of your submission.
